Decision to come later after hearing on Gray's runoff election

Rooster Cogburn had his day in court Dec. 28 concerning five uncounted votes in the runoff election for mayor pro tem. The five votes were the exact number that separated the challenger and the incumbent, Loretta Lipsey.

When Cogburn’s request for a recount of the votes was denied by Gray Election Superintendent Jamie Lewandowski, his options were to accept the results or contest the election.

Cogburn’s attorney put up witnesses as did City Attorney Joan Harris, but at the end of the two-hour hearing, it is the opinion of Dublin’s Chief Superior Court Judge H. Gibbs Flanders, who presided over the case, that matters.

After hearing the witnesses from both sides and the arguments of the attorneys, Flanders said he needs time to review the evidence. The judge said he will send his written decision to the attorneys.
